Clarification: Fire Extinguishers

Following recent concerns raised by Passenger Carrying Vehicle (PSV) Operators regarding fire extinguisher checks and the issuance of ORNs (Operator Report Notices) by the DVSA, we want to clarify the minimum requirements for fire extinguisher condition and compliance on PSV's.

Fire Extinguisher Inspection Requirements

To ensure compliance and safety, the following checks must be carried out regularly:

  1. Readily Available for Use
    The extinguisher must be easily accessible and not obstructed in any way.
  2. Pressure Gauge Check
    Where a gauge is fitted, the needle must be within the green zone, indicating the extinguisher is pressurised and ready for use.
  3. Tamper Seal and Locking Pin
    The safety seal (tamper indicator) and locking pin must be intact and unbroken. This confirms the extinguisher has not been discharged or tampered with.
  4. Physical Condition
    The extinguisher must be free from:
    1. Material dents
    2. Rust or corrosion
    3. Damage to the body, hose, nozzle, or handle
  5. Correct Markings
    The extinguisher must be clearly marked with one of the following British Standards Institution specification numbers:
    1. BS 5423
    2. BS EN3
    3. EN3

The DVSA's Position

Some operators have reported receiving ORNs due to the absence of service dates and signatures on extinguishers—requirements typically associated with business premises, not vehicles.

The RHA and CPT (Confederation of Passenger Transport) have worked with the DVSA to resolve this misunderstanding. DVSA has confirmed:

  • Operators must demonstrate they have a system in place for checking extinguishers. This can be evidenced through:
    • Pre-MOT inspections
    • PMIs (Preventative Maintenance Inspections)
    • Any other documented process

In Summary

While extinguishers in vehicles do not require service labels or signatures like those in buildings, they must meet the above physical and compliance checks. If an ORN is issued, providing evidence of your inspection system will satisfy DVSA requirements. An ORN will not affect an operators OCRS Score.
